This is a civil action brought by the Plaintiff, John Smith, individually and as Trustee for the Workforce Safety and Insurance Organization, against the Defendant Atlas Grain Elevator, a corporation, to recover damages for personal injuries sustained by the Plaintiff while upon the premises of the Defendant's grain elevator at Bountiful, North Dakota, on October 27, 1984.
