  • The Defendant intended to inflict emotional distress if the Defendant desired to cause such distress or knew that such distress was substantially certain to result from the Defendant's conduct.

     

    The Defendant's conduct was reckless if the Defendant had knowledge of a high degree of probability that emotional distress would result and acted with deliberate disregard of that probability or with a conscious disregard of the probable results.
