  • The extreme and outrageous character of the Defendant's conduct may arise from the Defendant's knowledge that the Plaintiff is especially susceptible to emotional distress because of some physical or mental condition or peculiarity. Conduct may become extreme and outrageous when the Defendant proceeds despite such knowledge, although it would not be so if the Defendant did not know.
