  • The receipt of workers’ compensation benefits should not be considered by you in determining the amount of damages to be recovered, if any. [This lawsuit was brought in [the Plaintiff’s] behalf and as Trustee in behalf of the State of North Dakota workers’ compensation agency to recover compensation for the damages [the Plaintiff] sustained, if any.
