  • It is unlawful for a person who is at least twenty-one years of age to solicit, induce, intimidate, employ, hire or, use a person under eighteen years of age to unlawfully transport, carry, sell, give away, prepare for sale, or peddle a controlled substance.

     

    ESSENTIAL ELEMENTS OF THE OFFENSE

     

    The State’s burden of proof is satisfied if the evidence shows, beyond a reasonable doubt, the following essential elements:

     

    1) On or about [month] [day] [year], in [County], North Dakota, the Defendant, _______________;

     

    2) [Solicited] [induced] [intimidated] [employed] [hired] [used] a person under eighteen years of age to unlawfully [transport] [carry] [sell] [give away] [prepare for sale] [peddle] a controlled substance, _______________; and

     

    3) The Defendant was at least twenty-one years of age when the offense was committed.
