A person who is, or who poses as a therapist, and who intentionally has sexual contact with a patient or client during any treatment, consultation, interview, or examination is guilty of the crime of Sexual Exploitation by a Therapist.

ESSENTIAL ELEMENTS OF THE OFFENSE

The State’s burden of proof is satisfied if the evidence shows beyond a reasonable doubt the following essential elements:
